  • Consent - we have permission from you after we gave you all the relevant information. All of your data protection rights may apply, except the right to object. To be clear, you do have the right to withdraw your consent at any time. 

  • Contract – we have to collect or use the information so we can enter into or carry out a contract with you. All of your data protection rights may apply except the right to object. 

  • Legal obligation – we have to collect or use your information so we can comply with the law. All of your data protection rights may apply, except the right to erasure, the right to object and the right to data portability. 

  • Legitimate interests - we’re collecting or using your information because it benefits you, our organisation or someone else, without causing an undue risk of harm to anyone. All of your data protection rights may apply, except the right to portability. Our legitimate interests are: 

    • We collect and use personal details for 4 reasons: We need to collect personal information about a patient's health in order to provide them with the best possible treatment. By requesting treatment and our agreement to provide that care constitutes a contract. They can, of course, refuse to provide the information, but if they were to do that we would not be able to provide treatment. We have a ‘Legitimate Interest’ in collecting that information because without it we could not do our job effectively and safely. We also think that it is important that we can contact a patient in order to confirm their appointments with us or to update them on matters related to their medical care. This again constitutes ‘Legitimate Interest’ but this time it is their legitimate interest. Provided we have a patient\'s consent, we may send them exercises electronically. They may withdraw this consent at any time. We have a legal obligation to retain records for 7 years after your most recent appointment (or age 25 if this is longer), but after this period a patient can ask us to delete records if they so wish. After 7 years (or age 25 if longer) we will dispose of a patient\'s records.

  • Vital interests – collecting or using the information is needed when someone’s physical or mental health or wellbeing is at urgent or serious risk. This includes an urgent need for life sustaining food, water, clothing or shelter. All of your data protection rights may apply, except the right to object and the right to portability.

Where we get personal information from

How long we keep information 
We keep adult patient records for 8 years from the last treatment or death, while child records (under 18) are kept until their 25th birthday, or 26th if treated at 17, following GDPR and national guidance, always ensuring secure storage and clear disposal policies.  

 

Who we share information with 
Data Processors 
Stripe 

This data processor does the following activities for us: We do not store the full payment details on our own servers. Stripe, a trusted third-party payment processor, handles and stores this information securely on our behalf, in compliance with industry standards like PCI-DSS. We might store a customer identifier or a limited set of non-sensitive information (like the last four digits of a card and its expiration date) that is securely provided by Stripe, which allows you to manage payments and subscriptions without having access to the raw details. 
 
Rehab Guru 

This data processor does the following activities for us: Data Processor for Physiotherapy, Sports Massage and special populations (Prenatal, Osteoporosis, etc). Rehab Guru provides the software and infrastructure for us to collect, store, and deliver exercise programs, essentially processing the data on behalf of the controller (Curious Physio/Barreflies). 
 

Wix 

Wix processes our0 site visitors' data as instructed by us and for the purpose of providing their services to you. 
Data Processing Agreement (DPA): Wix provides a binding Data Processing Agreement that outlines its obligations as a data processor and is designed to help you comply with data protection laws like the GDPR and CCPA. You can review the Wix Data Processing Agreement for more information. 


Security Measures: Wix implements various technical and organisational security measures to protect the data it processes. 
 
Others we share personal information with 

  • Other health providers (eg GPs and consultants where written consent is provided by the patient/ client). 

 
 
Duty of confidentiality 

We are subject to a common law duty of confidentiality. However, there are circumstances where we will share relevant health and care information. These are where: 

  • you’ve provided us with your consent (we have taken it as implied to provide you with care, or you have given it explicitly for other uses); 

  • we have a legal requirement (including court orders) to collect, share or use the data; 

  • on a case-by-case basis, the public interest to collect, share and use the data overrides the public interest served by protecting the duty of confidentiality (for example sharing information with the police to support the detection or prevention of serious crime); 

  • If in England or Wales – the requirements of The Health Service (Control of Patient Information) Regulations 2002 are satisfied; or 

  • If in Scotland – we have the authority to share provided by the Chief Medical Officer for Scotland, the Chief Executive of NHS Scotland, the Public Benefit and Privacy Panel for Health and Social Care or other similar governance and scrutiny process. 

 
Sharing information outside the UK 
Where necessary, we will transfer personal information outside of the UK. When doing so, we comply with the UK GDPR, making sure appropriate safeguards are in place.

Transfer mechanism 

When transferring data outside of the European Economic Area (EEA) to countries that do not have an "adequacy decision" (meaning the European Commission hasn't determined their data protection level is equivalent to the EU's), Wix relies on specific legal safeguards:  

  • Standard Contractual Clauses (SCCs): Wix uses the current set of SCCs, approved by the European Commission, as the primary legal mechanism for such data transfers. 

  • Adequacy Decisions: Transfers to certain countries, like Israel where Wix.com Ltd. is based, are covered by the European Commission's adequacy decisions, which recognize their sufficient level of data protection. 

  • Additional Safeguards: Alongside SCCs, Wix implements "additional technical, contractual and organizational safeguards" to ensure data remains protected to industry standards, even if local legal requirements in the destination country are lesser.
